I. OBJECT

This Legal Notice regulates the conditions of use of the website www.molinsfilmfestival.com (hereinafter, the Website) that TERROR MOLINS FILM FESTIVAL (hereinafter, also TERRORMOLINS) makes available to users in order to provide them with information on products and services, either its own or those of third party collaborators, and to facilitate access to the same (all of which are jointly referred to as the Services).

TERRORMOLINS has its registered office at C/Jacint Verdaguer, 18 1º3ª - 08750 Molins de Rei (Barcelona) and is registered as a non-profit association in the Register of Associations of Catalonia, in section 1a of the Register of Barcelona, with number 36844, and with tax identification number G64859424. Use of the Website confers the status of User, which implies adherence to the Legal Notice in the version published at the time of accessing it. TERRORMOLINS reserves the right to modify, at any time and without prior notice, the presentation, and configuration of the Website, as well as its Legal Notice. TERRORMOLINS therefore recommends that the User read the Legal Notice carefully each time they access the Website.

The use of the Website is not intended for children under 14 years of age, and they must therefore refrain from providing any information of a personal nature. In this respect, TERRORMOLINS recommends the use of the Website to people over 18 years of age. To this end, TERRORMOLINS reserves the right to check the age of Users at any time.

Access to certain Services may be subject to certain specific conditions which, depending on the case, replace, complete and/or modify this Legal Notice. Therefore, prior to accessing and/or using such Services, the User must also carefully read the corresponding specific conditions.

II. ACCESS AND SECURITY

In general, Users may access the Website freely and free of charge, without prejudice to the cost of connection through the telecommunications network supplied by the Internet access provider (contracted by the User).

However, for the use of certain services (purchase of merchandising, tickets, etc.), registration on the Website may be required by providing a username (an e-mail address) and password. If requested, this registration may be carried out from the Website itself, free of charge and allowing the User to be identified on multiple devices (hereinafter referred to as the TERRORMOLINS User Account).

Obtaining a TERRORMOLINS User Account is limited to those over 14 years of age. TERRORMOLINS reserves the right to ask Users who have a TERRORMOLINS User Account for a photocopy of their identity document (DNI, NIE or passport) at any time to check that they meet this requirement and to cancel the TERRORMOLINS User Account of any User who does not provide it or who is not over 14 years of age.

The use of the access data to the TERRORMOLINS User Account (username and password) is personal and non-transferable, and it may not be given up, even temporarily, to third parties. In this regard, the User commits to use them diligently and to keep their username and password secret, assuming all responsibility for the consequences of their disclosure to third parties. In the event that the User knows or suspects that their access number and/or password is being used by third parties, they must inform TERRORMOLINS of this circumstance as soon as possible.

III. CORRECT USE OF THE SERVICES

The User commits to use the Services diligently, correctly and according to the law and, in particular, commits to refrain from:

Using the Services in a manner that is, for purposes or with effects, contrary to law, morality and generally accepted good customs or public order;
Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the Services, unless authorised by the owner of the corresponding rights, or it is legally permitted;
Infringing intellectual or industrial property rights belonging to TERRORMOLINS or third parties; and using the Services and, in particular, information of any kind obtained through the Website to send advertising, communications for the purposes of direct sales or any other kind of commercial purpose, unsolicited messages addressed to a number of people regardless of their purpose, as well as to market or disseminate said information in any way.

The User shall be liable for damages of any kind that TERRORMOLINS may suffer, directly or indirectly, as a result of non-compliance with any of the obligations arising from this Legal Notice, the Privacy, and Cookies Policies, the corresponding specific conditions or the law in relation to the use of the Website. TERRORMOLINS shall at all times ensure that the current legal system is respected, and shall be entitled to interrupt, at its sole discretion, the Services or exclude the User from the Website in the event of the alleged commitment, whether complete or incomplete, of any of the crimes or offences defined by the Criminal Code in force, or in the event of any conduct which, in the opinion of TERRORMOLINS, is contrary to the morals, order, good customs or internal rules of TERRORMOLINS or its collaborators or which may disturb the proper functioning, image, credibility and/or prestige of TERRORMOLINS or its collaborators. In any case, TERRORMOLINS has no obligation to control and does not control the content transmitted, disseminated or made available to third parties by Users or collaborators, except in cases where this is required by current legislation or when required by a competent judicial or administrative authority. In any case, the User is aware and accepts, voluntarily and expressly, that the use of the Website is in all cases under their sole and exclusive responsibility.

IV. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

All the contents of the Website (such as texts, graphics, photographs, illustrations, logos, icons, images, videos, commercial names, trademarks or distinctive signs, graphic design, source code, software and any other elements that appear on the Website) are the exclusive property of TERRORMOLINS or third parties, whose rights TERRORMOLINS recognises, and are subject to intellectual and industrial property rights protected by national and international legislation.

No intellectual or industrial property rights over the Website or any of its constituent elements are transferred to the User, and the reproduction, transformation, distribution, public communication, making available, extraction, reuse, or use of any nature, by any means or procedure, of any of them is expressly prohibited to the User, except in cases in which this is legally permitted or authorised by the holder of the corresponding rights.

TERRORMOLINS accepts no liability whatsoever, whether for consequential damages or loss of profit, in the event of interruptions to the Services, delays, errors, malfunctioning of the same and, in general, other inconveniences that have their origin in causes beyond the control of TERRORMOLINS, and/or due to the wilful or negligent actions of the User and/or due to Force Majeure. Without prejudice to the provisions of article 1105 of the Civil Code, the concept of Force Majeure shall also include all events beyond the control of TERRORMOLINS, such as: failure of third parties, operators or service companies, acts of Government, lack of access to third party networks, acts, or omissions of the Public Authorities, those others produced as a consequence of natural phenomena, blackouts, etc. and the attack by hackers or third parties specialised in the security or integrity of the computer system, provided that TERRORMOLINS has adopted all the security measures available to it in accordance with the options available.

The information associated with the Services is for guidance only. TERRORMOLINS will try as far as possible to update and rectify the information hosted on the Website.

TERRORMOLINS does not guarantee or assume any type of liability for the results obtained or for any damages suffered as a result of access to third-party Services through connections or links to the linked sites. The function of the links that appear on TERRORMOLINS is exclusively to inform the User of the existence of other sources of information on the Internet, where they can expand the Services offered by the Website. TERRORMOLINS accepts no liability for the use made by the User of the Website Services or of their access data, or of any other material related to the Services, infringing the intellectual or industrial property rights or any other rights of third parties.

Any exclusion of liability shall be understood to be made without prejudice to the legal guarantees and coverage applicable to Users who have the legal status of consumers according to current legislation.

VII. PROCESSING OF PERSONAL DATA

In accordance with the provisions of (EU) Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation - GDPR); Organic Law 15/1999, of 13 December, on the Protection of Personal Data (LOPD); Royal Decree 1720/2007, of 21 December, Regulation for the development of Organic Law 15/1999, of 13 December, on the Protection of Personal Data (RLOPD); and LSSICE 34/2002, of 11 July, on the Information Society and Electronic Commerce, informs all users who provide or will provide their personal data unequivocally, expressly and freely, that they will be included in a file owned by the MOLINS DE REI TERROR FILM FESTIVAL. The User shall be responsible, in all cases, for the veracity of the data provided, and TERRORMOLINS reserves the right to exclude from the registered Services any User who has provided false data, without prejudice to any other actions that may be applicable by law.

TERRORMOLINS recommends the use of the Website to people over 18 years of age. Likewise, when the user makes a comment on social networks, the social network and not TERRORMOLINS will be responsible for the processing of the data provided through the same, and the user must contact the same to exercise their rights of access, rectification, cancellation, and opposition.

TERROR MOLINS FILM FESTIVAL warns the user that, except for the existence of a legally constituted representation, no user may use the identity of another person and communicate their personal data, so the user must at all times bear in mind that they may only provide personal data corresponding to their own identity and which are adequate, relevant, current, accurate and true. In any case, the user must respect the privacy of third parties, whether or not they are users of the social network or of the official TERROR MOLINS FILM FESTIVAL page on the same. The user/customer accepts that TERRORMOLINS may obtain data for the purposes of the corresponding authentication of access controls. Internet purchase transactions are managed by a financial institution (virtual POS or Paypal), which receives the credit card numbers and other personal data of the cardholders solely for the purpose of verifying said data and executing the transactions.

IX. REVISIONS TO THIS POLICY

TERROR MOLINS FILM FESTIVAL may modify and/or substitute at any time any of the legal texts housed on its website ‘www.molinsfilmfestival.com’, including all the conditions and policies contained therein, in such a way that, depending on the case, it will substitute, complete and/or modify the one currently published here. X. APPLICABLE LAW AND JURISDICTION

The conditions of use contained in this Legal Notice shall be governed by the provisions of common Spanish legislation. In the event of any discrepancy or dispute arising from the interpretation or application of the aforementioned conditions of use, TERRORMOLINS and the User, expressly waiving any other jurisdiction to which they may be entitled, submit to the jurisdiction of the Courts and Tribunals of the User's domicile. In the event that the User is domiciled outside the European Union, and expressly waiving any other jurisdiction that may correspond to them, the parties shall submit to the jurisdiction of the Courts and Tribunals of Barcelona (Catalonia, Spain).
